Terms of use

1. Acceptance of terms

Everywhere’s Local consists of online resources dealing with online classifieds, events, job postings, news, weather, and other items (hereafter “service”). By using our services you hereby agree to our terms of use (hereafter “terms”). These terms may be changed at any time, and at our discretion. You must agree to the terms before making any posts to our site; as well as understand them before using our site.

2. Content

All images, news, posts, audio, video, messages, or other material (“content”) on Everywhere’s local is entered by visitors to our site, or people acting on their behalf. You realize that all material posted is the sole responsibility to those who posted it, and that we do not monitor or maintain any information, nor are we responsible for any content, linked content, or other information that’s posted to our site. We make no warranty or claim to the validity of any items posted on our site, nor any information linked to or from our or other sites. You understand that any and all information that you post to our site is solely your responsibility, and that all information that's linked ("3rd party content") is the responsibility of those sites as based on their terms, and is in no way related to us.

3. Rights Infringement

If your copyright or other information is violated, or you believe it to be violated, contact us at abuse@everywhereslocal.com or write us at:

Be sure to include the post title, id (if available), and as much information as possible. Copy and/or print the post out. Also include:
a. statement by you that the content’s use isn’t authorized by the copyright owner
b. A statement by you declaring under penalty of perjury that (a) the above information in your Notice is accurate, and (b) that you are the owner of the copyright interest involved or that you are authorized to act on behalf of that owner
c. Your physical address, telephone number, and e-mail address
d. Physical or electronic signature
We do take these issues seriously; however, we do need proof that you do own the rights, and the other doesn’t.

4. Privacy and Information Disclosure

Any information that you post to our site will be visible to others; however, the items that will be visible are obvious (post content, e-mail address if listed in the body). No information will be leased, sold, auctioned, given, or otherwise handed over to other parties without a warrant or written consent or as otherwise required by law. Any information that you tell to put on the website can be visible to everyone who visits the site.

5. Conduct

By using the site you agree not to post, use or make available any content:

• that is harmful, threatening, damaging, libelous, invasive of another's privacy, or harmful to minors in any way
• that is Pornographic in nature, whereas genitals are visible, sexual acts are transpiring or implied, sexual intercourse with a human or non-human, or any content wherein the sole purpose is to arouse or create a sexual atmosphere.
• that Harasses or degrades an individual based on age, gender, race, creed, religion, disability, sexual orientation, or anything else including but not limited to hair color.
• that impersonates another person or entity, including but not limited to Everywhere’s Local personnel, or implies that you are affiliated with a person or entity that you are not
• that uses a scam, con, MLM, phishing, spam, pyramid scheme, bait-and-switch, or other similar illegal content
• that infringes on any copyright, trademark, trade secret, proprietary rights of a party
• that contains a affiliate code, affiliate link, or other commercial income generating material; except where such content was approved by means of an advertising banner
• that contains a virus, worm, adware, or other computer software item that can slow, damage, or destroy: data, software, hardware, electronic equipment, or any other item it may come across
• that advertises any item that’s illegal for sale in your state or the state of Illinois, or the state of California, or in the country, or in the country, or in the world where you reside.
• that advertises for sale, rent, lease, free, auction, or other method of transfer any human body part, alcohol (without proper age verification methods, given that it is otherwise legal), children, foods, explosives, or other potentially hazardous material; including, but not limited to, any items that cannot be shipped through normal means (exceptions being a business service, ex: hospital, catering services, etc)
• that intentionally forges headers or contains misleading information to misguide or hide the true individual behind the content
• that violates the FAIR HOUSING laws of the United States (if the post is in the United States), and of the location where the real-estate item is listed. Likewise does not violate any housing laws of the country which the real-estate item is listed.

6. Disclaimer of Warranties

YOU AGREE THAT USE OF EVERYWHERE’S LOCAL SITE AND THE SERVICE IS ENTIRELY AT YOUR OWN RISK. THE EVERYWHERE’S LOCAL SITE AND THE SERVICE ARE PROVIDED ON AN "AS IS" OR "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND. ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF PROPRIETARY RIGHTS ARE EXPRESSLY DISCLAIMED TO THE FULLEST EXTENT PERMITTED BY LAW. TO THE FULLEST EXTENT PERMITTED BY LAW, EVERYWHERE’S LOCAL DISCLAIMS ANY WARRANTIES FOR THE SECURITY, RELIABILITY, TIMELINESS, ACCURACY, AND PERFORMANCE OF THE EVERYWHERE’S LOCAL SITE AND THE SERVICE. TO THE FULLEST EXTENT PERMITTED BY LAW, EVERYWHERE’S LOCAL DISCLAIMS ANY WARRANTIES FOR OTHER SERVICES OR GOODS RECEIVED THROUGH OR ADVERTISED ON THE EVERYWHERE’S LOCAL SITE OR THE SITES OR SERVICE, OR ACCESSED THROUGH ANY LINKS ON THE EVERYWHERE’S LOCAL SITE. TO THE FULLEST EXTENT PERMITTED BY LAW, EVERYWHERE’S LOCAL DISCLAIMS ANY WARRANTIES FOR VIRUSES OR OTHER HARMFUL COMPONENTS IN CONNECTION WITH THE EVERYWHERE’S LOCAL SITE OR THE SERVICE. 7. Limitations of Liability

UNDER NO CIRCUMSTANCES SHALL EVERYWHERE’S LOCAL BE LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES (EVEN IF EVERYWHERE’S LOCAL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM ANY ASPECT OF YOUR USE OF THE EVERYWHERE’S LOCAL SITE OR THE SERVICE, WHETHER THE DAMAGES ARISE FROM USE OR MISUSE OF THE EVERYWHERE’S LOCAL SITE OR THE SERVICE, FROM INABILITY TO USE THE EVERYWHERE’S LOCAL SITE OR THE SERVICE, OR THE INTERRUPTION, SUSPENSION, MODIFICATION, ALTERATION, OR TERMINATION OF THE EVERYWHERE’S LOCAL SITE OR THE SERVICE. SUCH LIMITATION SHALL ALSO APPLY WITH RESPECT TO DAMAGES INCURRED BY REASON OF OTHER SERVICES OR PRODUCTS RECEIVED THROUGH OR ADVERTISED IN CONNECTION WITH THE EVERYWHERE’S LOCAL SITE OR THE SERVICE OR ANY LINKS ON THE EVERYWHERE’S LOCAL SITE, AS WELL AS BY REASON OF ANY INFORMATION OR ADVICE RECEIVED THROUGH OR ADVERTISED IN CONNECTION WITH THE EVERYWHERE’S LOCAL SITE OR THE SERVICE OR ANY LINKS ON THE EVERYWHERE’S LOCAL SITE. THESE LIMITATIONS SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW. In some jurisdiction, limitations of liability are not permitted. In such jurisdictions, some of the foregoing limitation may not apply to you.

8. Indemnity

You agree to indemnify and hold Everywhere’s Local, its officers, subsidiaries, affiliates, successors, assigns, directors, officers, agents, service providers, suppliers and employees, harmless from any claim or demand, including reasonable attorney fees and court costs, made by any third party due to or arising out of Content you submit, post or make available through the Service, your use of the Service, your violation of the Terms, your breach of any of the representations and warranties herein, or your violation of any rights of another.
